Elections Nova Scotia entered into a compliance agreement with the Nova Scotia New Democratic Party (the “NSNDP”) yesterday. According to the notice of compliance agreement, the NSNDP breached sections 271 and 272 of the Elections Act (Nova Scotia) when it published its fall caucus brochure.
The brochure was transmitted by the Nova Scotia Government, and did not include the required notation that it was authorized by the NSNSP’s official agent.
Some of the brochures were also printed and distributed, meaning that the costs of these brochures are being considered as an election expense.
Thus, 10 days after dismissing the matter as “childish”, the NSNDP are admitting that the fall caucus brochure breached the Elections Act and have taken responsibility for it.
